APARTMENT PROCEDURE FOR SALE (PART 2) - IMPLEMENTATION PROCEDURES

In addition to meeting the conditions of the subject and apartment in transactions, when selling an apartment, there are also issues to focus on such as: content of the contract; implementation order and procedures; fees and charges payable, ... Therefore, to ensure their rights, as well as minimize future risks, the parties need to follow the procedure in Article 120 of the Housing Law 2014, specifically as after:
Step 1: Make an apartment sale and purchase contract. The contract must be made in writing, including the contents specified in Article 121 of the Law on Housing 2014.
Step 2: Notarization and certification of the contract. Submit the application to the District Housing and Land Registration Office and declare and pay taxes.
Step 3: Agreement for one party to apply for the Certificate of Housing.
Documents to be prepared include:
- ID card, Household registration book (certified true copy);
- Marriage registration certificate or single status certificate;
- Birth certificate (if any);
- Certificate of land use rights, ownership of houses and other land-attached assets of the apartment building (original).
- House sale and purchase contract (original notarized, authenticated).
- Power of attorney if the third person goes to do the procedure.
An administrative declaration dossier set includes:
- Application for registration of land change;
- Non-agricultural land use tax return;
- Registration fee declaration;
- Personal income tax return.
Step 4: The land use right registration office shall consider issuing the Certificate. The parties to perform financial obligations include:
- Personal income tax
- Registration fee
- Evaluation fee
- Sale contract notarization fee
- Registration fee for land changes.
Thus, in order to sell an apartment, in addition to meeting the statutory conditions, the parties need to follow the order and procedures specified above. These procedures ensure the rights and obligations of the parties in accordance with the law, avoiding future legal risks.
