How will a person intendedly ran away from isolation be handled?

1️⃣ Regulations on handling individuals infected with Covid's disease - 19 in isolation
➡️ Under the provisions of Article 1 of Decision 219 / QD-BYT and Clause 5, Article 1 of Decision 447 / QD-Ttg, add nCoV-induced acute respiratory infections to the list of group A infectious diseases.
➡️ Under the provisions of Point b, Clause 2 and Clause 3, Article 11 of Decree 117/2020 / ND-CP, a fine of from VND 15,000,000 to VND 20,000,000 shall be imposed for refusing or evading the application of the decision. medical isolation, medical isolation enforcement by competent state agencies for people suffering from group A infectious diseases subject to border quarantine who suffer from group A infectious diseases or when state agencies authoritative request. Individuals fleeing isolation will also be subject to enforcement of medical isolation.
➡️ Under the provisions of Clause a, Point 1.1, Official Dispatch No. 45 / TANDTC-PC, the person who has been notified of the disease; a person who is suspected of being infected or returning from an area where Covid-19 epidemic has been notified of isolation but escapes from the isolation place, causing transmission of Covid-19 epidemic to another person shall be considered as the case of carrying out "acts. other people spreading dangerous epidemics ”as stipulated at Point c, Clause 1, Article 240 of the 2015 Penal Code, and handled for spreading infectious epidemics to humans.
➡️ According to Article 240 of the 2015 Penal Code, Crime of spreading dangerous infectious diseases to humans:
1. Those committing one of the following acts, causing the spread of dangerous infectious epidemic to human shall be subject to a fine ranging from VND 50,000,000 to VND 200,000,000 or a prison term ranging from 01 to 05 years:
a) Bringing out or allowing to bring out animals, plants, products made from animals or plants or other products that are capable of spreading dangerous epidemic to human from the area with epidemic, unless other situations provided by the law;
b) Bringing into or allowing to bring animals, plants or products made from animals or plants that are infected or carrying dangerous pathogen which are capable of spreading disease to human into the Vietnamese territory;
c) Other acts of spreading dangerous epidemic to human.
2. In case of committing the crime in one of the following circumstances, violators shall be sentenced to 05 to 10 years of imprisonment:
a) Resulting in the epidemic declaration under the authority of the President of the Province’s People's Committee or the Minister of Health;
b) Causing human's death.
3. In case of committing the crime in one of the following circumstances, offender shall be sentenced to 10 to 12 years of imprisonment:
a) Resulting in the epidemic declaration under the authority of the Prime Minister;
b) Causing the death of 02 or more people.
4. Offender shall be subject to bare a fine of between VND 20,000,000 and VND 100,000,000, a ban from holding certain positions, practicing certain occupations or doing certain jobs from 01 to 05 years.
2️⃣ Handling regulations for people who are left isolation on their own:
➡️ Under the provisions of Point b, Clause 1 and Clause 3, Article 11 of Decree 117/2020 / ND-CP, a fine of from VND 5,000,000 to VND 10,000,000 shall be imposed for refusing or evading the application of the measure. medical isolation, medical isolation enforcement by competent state agencies. Individuals fleeing isolation will also be subject to enforcement of medical isolation.
➡️ According to the provisions of Clause a, Point 1.2, Official Dispatch No. 45 / TANDTC-PC, the person who has not been identified as suffering from Covid-19 but lives in the area has had an isolation decision, a decision to blockade but escaped from the affected area. Isolation causes a loss of 100,000,000 VND or more due to the cost of epidemic prevention and control, and shall be handled for the violation of safety regulations in crowded places according to Article 295 of the Annual Penal Code. 2015.
➡️ According to Article 295 of the 2015 Penal Code, as amended and supplemented in 2017, Crime of violating regulations on occupational safety, occupational health, and safety in crowded places:
1. Those who violate the regulations on labor safety, labor hygiene, safety in crowded places and cause damage to other people in one of the following cases shall be subject to a fine of between VND 20,000,000 up to 100,000,000 VND, a fine of up to 03 years for non-custodial reform or a prison term of between 1 and 5 years:
a) Causing death;
b) Inflicting injury on or causing harm to the health of 01 person with an injury rate of 61% or higher;
c) Inflicting injury on or causing harm to the health of 02 or more people with a total bodily injury rate of between 61% and 121%;
d) Causing a loss of property from VND 100,000,000 to under VND 500,000,000.
2. Committing the crime in one of the following circumstances, the offenders shall be sentenced to between 3 and 7 years of imprisonment:
a) Causing death of 02 people;
b) Inflicting injury on or causing harm to the health of 02 or more people with the total rate of bodily injury of these persons from 122% to 200%;
c) The offense causes a loss of property from VND 500,000,000 to less than VND 1,500,000,000;
d) Being responsible for occupational safety, occupational hygiene, and safety in crowded places.
3. Committing the crime in one of the following circumstances, the offenders shall be sentenced to between 06 and 12 years of imprisonment:
a) Causing death of 03 or above
b) Inflicting injury on or causing harm to the health of 03 or more people with a total bodily injury rate of 201% or more;
c) Causing damage to property of VND 1,500,000,000 or more.
4. Violation of regulations on labor safety, labor hygiene and safety in crowded places in cases where there is a practical possibility leading to consequences specified at points a, b and c, Clause 3 This, if not prevented in time, shall be subject to non-custodial reform for up to 2 years or a prison term of between 3 months and 2 years.
5. Offenders may also be subject to a fine of between 10,000,000 VND and 50,000,000 VND, a ban from holding certain posts, practicing certain occupations or doing certain jobs for 1 to 5 years.
? Based on the stated grounds, a person infected with Covid - 19 who escapes from the isolation ward may be subject to a fine of between VND 15,000,000 and VND 20,000,000 and subject to enforcement. In the case of epidemic spread, criminal prosecution may be considered for causing the spread of dangerous infectious epidemics to humans with a fine ranging from VND 50,000,000 to VND 200,000,000 or a prison term of between 1 year. up to 12 years depending on the specific situation.
? For an individual who has not been identified as having Covid-19 disease but living in an area with an isolation decision, a blockade decision, but escaping from the quarantined area may be fined from 5,000,000 VND to 10,000 VND. 000 VND and was forced into isolation. In case of escaping from an isolated area and causing damage of VND 100,000,000 or more due to the cost of epidemic prevention and control, the offender shall be handled for violating regulations on safety in crowded places with the fine of VND 20,000,000 to VND 100,000,000, a fine of up to 03 years of non-custodial reform or a prison term of between 01 and 12 years based on the violation and the consequences.
