Currently in the world, the COVID-19 epidemic is still raging, but in Vietnam, we have controlled the epidemic very well and reduced the damage to the lowest level thanks to effective anti-epidemic measures. So let's find out, if individuals do not comply with the application of anti-epidemic measures as prescribed, how will they be punished.
Pursuant to Article 12 of Decree 117/2020/ND-CP stipulating the application of anti-epidemic measures.
- A fine of between VND 1,000,000 and 3,000,000 shall be imposed for one of the following acts:
- a) Failing to take personal protection measures for participants in the fight against epidemics and people at risk of contracting the disease according to the guidance of health authorities;
- b) Failing to report to the People's Committee or preventive medicine agency in the locality about the case of epidemic disease as prescribed by law.
- A fine of between VND 5,000,000 and 10,000,000 shall be imposed for one of the following acts:
- a) Concealing their own or other people's disease status when suffering from an infectious disease that has been declared epidemic;
- b) Failing to take or refuse to take measures to clean, disinfect and disinfect in epidemic areas;
- c) Failure to participate in the fight against the epidemic according to the mobilization decision of the Anti-epidemic Steering Committee;
- d) Collection of fees for examination and treatment for cases of group A infectious diseases;
vdd) Failing to implement the decision to force destruction of animals, plants and other objects that are vectors of disease, except for the cases specified at Point c, Clause 4 and Point d, Clause 5 of this Article.
- A fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed for one of the following acts:
- a) Failing to implement the decision to apply the measure of temporarily suspending the operation of a public food service establishment that is likely to cause disease transmission in the epidemic area;
- b) Failing to comply with the decision on application of measures to ban the trading and use of foods that are vectors of disease;
- c) Failing to implement the decision to apply measures to limit mass gatherings or to temporarily suspend business and service activities in public places.
- A fine ranging from VND 20,000,000 to VND 30,000,000 shall be imposed for one of the following acts:
- a) Failing to comply with the decision on medical examination, supervision and treatment before entering or leaving an epidemic area of group A;
- b) Take out of the epidemic area of group A articles, animals, plants, food and other goods capable of transmitting epidemics;
- c) Failing to implement the decision to force destruction of animals, food, plants and other objects that are vectors of group A diseases.
- A fine ranging from VND 30,000,000 to VND 40,000,000 shall be imposed for one of the following acts:
- a) Failing to comply with the request for medical examination and treatment of means of transport before leaving the epidemic area in an epidemic emergency;
- b) Failing to implement the decision to ban mass gatherings in areas where a state of emergency has been declared;
- ) Bringing people and vehicles not on duty into the outbreak in the area where the state of emergency has been declared;
- d) Failing to implement the decision to force the destruction of animals, food, plants and other objects that are at risk of spreading the epidemic to humans in the area where the state of emergency has been declared.
- Remedial measures:
- a) Enforce the application of measures to clean, disinfect and disinfect, for the acts specified at Point b, Clause 2 of this Article;
- b) Forcing the refund of the collected money in contravention of law, for the acts specified at Point d, Clause 2 of this Article. If the refund cannot be made to the subject, it shall be remitted to the state budget according to the provisions of law;
- c) Forcible destruction of animals, food, plants and other objects, for the acts specified at Points dd, Clause 2, Points b, c, Clause 4 and Point d, Clause 5 of this Article;
- ) Forcible medical handling of means of transport for the acts specified at Point a, Clause 5 of this Article.
Each person needs to voluntarily comply with the regulations on applying anti-epidemic measures so that they cannot become an agent of infectious disease spreading to the community. It is an effective way to protect our loved ones, family and those around us.
