{"id":3944,"date":"2021-05-07T08:16:00","date_gmt":"2021-05-07T01:16:00","guid":{"rendered":"http:\/\/medlaw.vn\/?p=3944"},"modified":"2021-05-27T15:02:45","modified_gmt":"2021-05-27T08:02:45","slug":"thoi-han-tam-giam-de-dieu-tra","status":"publish","type":"post","link":"https:\/\/medlaw.vn\/en\/thoi-han-tam-giam-de-dieu-tra\/","title":{"rendered":"TEMPORARY INTERESTING TIME"},"content":{"rendered":"<p><b>[LEGAL ARTICLE]<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Detention is a deterrent in criminal proceedings, in place to prevent a crime from occurring in a timely manner, or when there is evidence that the accused will continue to commit the crime; makes it difficult to investigate, prosecute, adjudicate or secure judgment enforcement.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to Clause 1 Article 173 <\/span><span style=\"font-weight: 400;\">2015 Criminal Procedure Code, <\/span><span style=\"font-weight: 400;\">The defendant's time limit for investigation is<\/span><span style=\"font-weight: 400;\">:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">- No more than 02 months for less serious crimes;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">- No more than 03 months for serious crimes;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">- No more than 04 months for very serious crimes and particularly serious crimes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> In cases where a case contains many complicated details, which require a longer investigation time, and there are no grounds to change or cancel the detention measure, the temporary detention measure shall be extended as follows:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">- Less serious crime: extended once for no more than 01 month;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">- Serious crime: extended once for no more than 02 months;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">- Very serious crime: extended once for no more than 03 months;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">- Extremely serious crime: is extended twice, each time does not exceed 04 months.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> T<\/span><span style=\"font-weight: 400;\">If it is necessary for a particularly serious crime that is not an infringement of national security and there is no ground to change or cancel the detention measure, an extension shall be made once for no more than 4 months.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In special cases where there are no grounds to cancel the detention measure, the decision to hold detention shall be made until the investigation ends.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> During the detention period, if deeming it unnecessary to continue the detention, the investigation authority must promptly request the Procuracy to cancel the detention in order to release the detained person or deem it necessary.
